Informovaný súhlas ako prejav vôle pacienta

Vzťah medzi lekárom a pacientom sa vyznačuje určitými osobitosťami, ktoré ho odlišujú od ostatných občianskoprávnych vzťahov. Poskytovať zdravotnú starostlivosť na základe súhlasu pacienta je po povinnosti lekára poskytovať ju „lege artis“ druhá najvýznamnejšia povinnosť lekára. Vôľa je esenciálnou zložkou právneho úkonu, a preto bez nej nemôže právny úkon vzniknúť. Vôľa musí byť daná, vážna, slobodná a bez omylu. Pre splnenie tejto podmienky je nevyhnutné poučenie, ktoré musí samotnému súhlasu predchádzať. Súčasťou poučenia má byť i vysvetlenie rôznych alternatív, ktoré súčasný stav medicíny voči navrhovanému zákroku ponúka. Najviac polemiky vzbudzuje otázka, nakoľko podrobne má byť pacient informovaný o možných rizikách. Zákon výslovne nepožaduje písomnú formu informovaného súhlasu. Písomná forma súhlasu nemusí byť zárukou úspechu v prípadnom konaní. Právne relevantnú vôľu môže prejaviť iba subjekt, ktorý má právnu subjektivitu a zároveň je spôsobilý takúto vôľu prejaviť, t. j. musí mať spôsobilosť na právne úkony. V konečnom dôsledku sa pacient prejavením svojej vôle nielenže zapojí do procesu liečby, ale určí, aká bude, resp. či vôbec bude. Informovaný súhlas sa nevyžaduje v prípade neodkladnej starostlivosti, ak nemožno včas získať informovaný súhlas, ale ho možno predpokladať; ochranného liečenia uloženého súdom podľa osobitného predpisu; ak ide o osobu, ktorá v dôsledku duševnej choroby alebo s príznakmi duševnej poruchy ohrozuje seba alebo svoje okolie, alebo ak hrozí vážne zhoršenie jej zdravotného stavu.
